Did Biden Illegally Bribe Andrew Yang for His Endorsement?

In this clip, Andrew Yang admits Biden promised him a future position. These comments raised eyebrows among Tulsi Gabbard’s supporters. TRANSCRIPT: Yang / Charlamagne tha God (McKelvey):

McKelvey: Had Biden promised you a cabinet position?
Yang: We talked, and, uh, y.. I mean I’d have a place in the administration is the pretty clear message.
McKelvey: You endorsed Joe Biden. But I remember you saying you wouldn’t endorse a candidate who didn’t endorse universal basic income. And Biden never has.
Yang:
Well what I said was, endorsing universal basic income would be a way come out and support you.

Could this run afoul of the law? Yang’s endorsement was viewed as a shock to many of his supporters. Here is the text of the law surrounding bribes for endorsements:
“Whoever, being a candidate, directly or indirectly promises or pledges the appointment, or the use of his influence or support for the appointment of any person to any public or private position or employment, for the purpose of procuring support in his candidacy shall be fined under this title or imprisoned not more than one year, or both; and if the violation was willful, shall be fined under this title or imprisoned not more than two years, or both.”

Charlamagne tha God seemed surprised by Yang’s endorsement. Yang had been very specific as to what would earn his endorsement. Immediately after Yang dropped out, he said:

“We’re already talking about the next steps. And if anyone wants my endorsement, all you have to do is come out for universal basic income, say every American should get $1,000 a month, and then I will be there with you on the trail the next day.”

Tulsi made known she supports UBI the day after Yang dropped out. She made the following Instagram post and directed to Andrew Yang:

Yang’s endorsement of Biden shocked several liberal commentators at the time:

Part of Yang’s endorsement might have come from a “special” phone call he had with Biden. Who knows what he was bribed with?
