With 4 million views, the following video clip, shared by Gavin Newsom, is making rounds on Twitter and other social networks. The video is taken out-of-context and the associated commentary is fake news.
The out-of-context video suggests Judge Barrett argued in 2016 “why it’s wrong to fill a SCOTUS vacancy during a presidential election year.”
This is misinformation.
If you watch the FULL VIDEO for the entire context, starting at 3:20, it’s clear that she’s not making an assertion. Rather, she is explaining what both sides’ positions will be.
In fact, she ultimately concludes the President has the power to nominate. The Senate has the power to act or not. After reviewing historic precedence, she says she doesn’t think any one side can claim there is a rule governing how the power dynamics between both sides plays out.
So you see, the fact her answer in 2016 applies perfectly to both the 2016 and 2020 SCOTUS nominating situations, only illustrates her wisdom.
